Rape is a sexual offense and is classified as a crime involving danger to a person. Generally, a person that has sexual intercourse with a person and compels such person to submit by force, against his or her will, or compels such person to submit by threat of bodily injury is guilty of rape whether or not the victim resists the attack. Most state rape laws also apply when the attacker is married to the alleged victim. Rape is a felony. The penalties vary and are more severe when physical injuries are involved. |
