A special jury that investigates to determine whether or not there is probable cause that the defendant committed the crime for which he or she is charged and that the prosecution has enough evidence to proceed to trial. The grand jury is comprised of jurors who will hear the evidence presented by the prosecutor. The jury will return an indictment if a majority find that there is probable cause. Neither the defendant or his or her attorney are allowed to be present. |
